1. 規約への同意と適用

本規約は、Kitokito Apps（以下「提供者」）が提供するiOS／iPadOSアプリ「KyudoNow」の利用条件です。アプリをダウンロードまたは利用することで、本規約に同意したものとみなされます。同意できない場合は利用しないでください。

本規約は、Appleの標準エンドユーザ使用許諾契約（Standard EULA）を補足します。矛盾する場合は、適用法令およびAppleの必須条件が優先します。

2. サービスの目的

KyudoNowは、弓道の稽古、的中、矢所、弓具、メモ、目標などを個人で記録し、振り返るための補助ツールです。競技の公式採点、審査判定、医療、診断、安全指導、専門家の助言を代替するものではありません。道場の規則、指導者の指示、周囲の安全を常に優先してください。

3. 利用許諾

提供者は、利用者が所有または管理するApple製端末上で、個人的かつ非独占的にKyudoNowを利用する、譲渡不能な限定ライセンスを付与します。適用法令またはオープンソースライセンスが認める場合を除き、再配布、再販売、リバースエンジニアリング、不正アクセス、権利保護機能の回避を行ってはなりません。

4. 利用者の記録と責任

利用者が入力した稽古記録、メモ、タグ、写真その他の内容の権利は、利用者または正当な権利者に帰属します。利用者は、入力・書き出し・共有する内容について必要な権利と許可を持ち、他者のプライバシー、著作権、秘密、道場規則を侵害しない責任を負います。

端末、iCloud Drive、CSV／JSON／PDFの保存先と共有先は利用者が管理します。機密情報や不要な個人情報を記録・共有しないでください。

5. Pro自動更新購読

• Proには月額プランと年額プランがあります。年額プランを推奨し、MVPでは無料体験を提供しません。
• 価格、通貨、税、期間は購入確認画面に表示されるApp Storeの商品情報が優先します。日本向けの初回設定は月額¥380、年額¥2,980です。
• 購入確認後、料金はApple Accountに請求されます。購読期間終了の24時間前までにキャンセルしない限り、選択した期間ごとに自動更新され、更新料金は期間終了前の24時間以内に請求されます。
• 購読の確認、変更、キャンセルは端末の「設定」→Apple Account→「サブスクリプション」から行えます。アプリを削除しただけでは購読はキャンセルされません。
• 購入済みの権利は、アプリ内の「購入を復元」から確認できます。返金の可否と処理はAppleの規約・手続きに従います。
• Proの機能、価格、提供範囲を変更する場合があります。価格変更や更新については、Appleが求める通知・同意手続きが適用されます。

6. iCloud Driveバックアップと復元

ProのiCloud機能は、記録、メモ、写真を利用者自身のiCloud Driveへバックアップし、利用者の確認後に端末へ復元する機能です。新しい保存は以前のKyudoNowバックアップを置き換えます。復元は端末内のKyudoNowデータをバックアップ内容で全置換し、既存データとのマージや重複追加は行いません。復元に失敗した場合は現在の端末内データを維持します。

この機能はリアルタイム同期や共同編集ではありません。重要なデータは定期的にJSONやCSV等へ書き出してください。iCloudの利用可能性、容量、Apple Account設定、通信、Appleのサービス状態により、保存や復元が遅延・失敗する場合があります。

7. 振り返り情報

MVPの「端末内振り返り」は、端末内の記録から決定的な規則で要点を整理する機能であり、AIによる文章生成や外部生成AIによる評価ではありません。表示内容は参考情報で、射技、健康、安全、審査結果を保証しません。最終判断は利用者自身と、必要に応じて指導者・専門家が行ってください。

8. 禁止事項

利用者は、法令違反、第三者の権利侵害、サービス妨害、不正な購読権利取得、マルウェア配布、アプリや外部サービスへの不正アクセス、危険な状況での端末操作を行ってはなりません。

9. 変更、中断、終了

提供者は、品質、安全、法令、プラットフォーム要件、運営上の理由により、アプリの全部または一部を変更、中断、終了することがあります。重要な変更は合理的な方法で告知します。利用者が本規約に重大に違反した場合、利用を制限できるものとします。

10. 保証の否認と責任制限

KyudoNowは、適用法令で認められる最大限の範囲で「現状有姿」かつ「提供可能な状態」で提供されます。提供者は、常時利用可能であること、誤りがないこと、データが失われないこと、特定の成果が得られることを保証しません。

適用法令で認められる範囲で、提供者は、データ消失、稽古・競技上の判断、間接損害、特別損害、結果的損害について責任を負いません。ただし、提供者の故意・重過失、消費者保護法その他強行法規により制限できない責任には、この制限を適用しません。

11. プライバシー

データの取扱いはKyudoNowプライバシーポリシーをご確認ください。Proの購読状態確認にはAppleおよびRevenueCatを利用します。MVPでは稽古データを外部生成AIへ送信しません。

12. 準拠法、規約変更、連絡先

本規約は、抵触法の原則を除き日本法に準拠します。紛争については、適用法令で許される範囲で、東京地方裁判所を第一審の専属的合意管轄裁判所とします。居住地の消費者保護に関する強行法規上の権利は妨げません。

本規約を変更する場合、更新日を改め、重要な変更はアプリ内または本ページでお知らせします。質問は件名に「KyudoNow Terms」と記載してご連絡ください。

1. Acceptance and scope

These Terms govern KyudoNow for iOS and iPadOS, provided by Kitokito Apps (“we,” “us,” or the “Provider”). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

These Terms supplement Apple’s Standard End User License Agreement. Applicable law and Apple’s mandatory terms control if there is a conflict.

2. Purpose

KyudoNow is a personal tool for recording and reviewing kyudo practice, hits, arrow places, equipment, notes, and goals. It is not an official scoring system and does not replace medical, diagnostic, safety, professional, instructor, competition, or examination advice. Always follow dojo rules, instructor guidance, and safe shooting practice.

3. License

We grant you a limited, personal, non-exclusive, non-transferable license to use KyudoNow on Apple-branded devices you own or control. Except where applicable law or an open-source license permits it, you may not redistribute, resell, reverse engineer, bypass technical protections, or gain unauthorized access to the app.

4. Your records and responsibilities

You or the relevant rights holder retain rights in the practice records, notes, tags, photos, and other content you enter. You are responsible for having the rights and permissions needed for anything you record, export, or share, and for respecting privacy, copyright, confidentiality, and dojo rules.

You control your device, iCloud Drive, and the destinations where you save or share CSV, JSON, and PDF exports. Do not record or share unnecessary personal or confidential information.

5. Pro auto-renewable subscriptions

• Pro is available as a monthly or yearly auto-renewable subscription. The yearly plan is recommended. The MVP does not offer a free trial.
• The price, currency, tax, and duration shown on the App Store purchase confirmation screen control. Initial Japan pricing is ¥380 per month or ¥2,980 per year.
• Payment is charged to your Apple Account after confirmation. The subscription renews for the selected period unless cancelled at least 24 hours before the end of the current period, and the renewal charge is made within 24 hours before that period ends.
• You can view, change, or cancel through Settings → Apple Account → Subscriptions. Deleting the app does not cancel a subscription.
• Use “Restore Purchases” in the app to check an existing entitlement. Refund eligibility and processing are governed by Apple’s policies and procedures.
• Features, prices, and availability may change. Apple’s required notice and consent processes apply to price changes and renewals.

6. iCloud Drive backup and restore

The Pro iCloud feature stores a backup of your records, notes, and photos in your own iCloud Drive and restores it only after your confirmation. A new save replaces the previous KyudoNow backup. Restore fully replaces local KyudoNow data with the backup and does not merge or append duplicates. If restore fails, current local data is kept.

This feature is not real-time synchronization or collaboration. Keep additional JSON or CSV exports of important data. Saving and restoring may be delayed or fail because of iCloud availability, storage capacity, Apple Account settings, connectivity, or Apple service conditions.

7. Reflection information

In the MVP, “On-device Reflection” uses deterministic rules on your device to organize information from your records; it is not AI-generated text or an assessment by an external generative-AI service. Results are informational and do not guarantee shooting performance, health, safety, competition, or examination outcomes. You and, when appropriate, an instructor or qualified professional remain responsible for decisions.

8. Prohibited conduct

You may not violate law or third-party rights, disrupt the service, obtain subscription access fraudulently, distribute malware, access the app or external services without authorization, or operate a device in an unsafe shooting situation.

9. Changes, suspension, and termination

We may change, suspend, or discontinue all or part of the app for quality, safety, legal, platform, or operational reasons. We will provide reasonable notice of material changes. We may restrict use for a material violation of these Terms.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, KyudoNow is provided “as is” and “as available.” We do not warrant uninterrupted availability, error-free operation, preservation of all data, or any particular result.

To the extent permitted by law, we are not liable for lost data, practice or competition decisions, or indirect, special, incidental, or consequential damages. This limitation does not apply where liability cannot be limited under applicable law, including liability caused by our willful misconduct or gross negligence and mandatory consumer-protection rights.

11. Privacy

See the KyudoNow Privacy Policy for data handling. We use Apple and RevenueCat to verify Pro subscription status. The MVP does not send practice data to an external generative-AI provider.

12. Governing law, changes, and contact

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. To the extent permitted by law, the Tokyo District Court has exclusive first-instance jurisdiction. Mandatory consumer rights in your place of residence remain unaffected.

We may update these Terms by changing the date above and presenting material changes in the app or on this page. Email questions with “KyudoNow Terms” in the subject line.
