Family Tree Now Terms of Service

Language: This is an English translation for convenience. If there is any conflict with the Japanese Terms of Service, the Japanese text prevails regarding governing law and jurisdiction, subject to mandatory consumer protection laws.
By using Family Tree Now (FamTreeNow, the “App”), you agree to these Terms of Service (“Terms”). If you use the paid Premium plan, these Terms apply together with the App Store information and Apple’s terms.
1. Scope
These Terms apply to your use of the App, whether free or paid, including data you create, save, import, export, or share through the App, rewarded ads, and Premium purchases. For information practices, see the Privacy Policy.
2. What the App does
The App helps users record and review family and relative information through family tree views, people records, timelines, statistics, search, backup, import, and export features.
The App does not automatically search public records, family registers, or genealogical sources. Content shown in the App is based on information entered or imported by users and related display or aggregation features. The App does not guarantee the accuracy of family relationships, legal status, inheritance relationships, ages, kinship terms, or other information.
We may change, suspend, or discontinue all or part of the App without prior notice except where required by law, and will try to provide reasonable notice where appropriate.
3. Accounts
The current version of the App does not require email registration or account creation. Apple, RevenueCat, Google, or other third-party services may process identifiers, purchase information, technical information, or similar data for purchase status, ads, or iCloud save/restore features. 4. User Data and Third-Party Information
Users are responsible for the data they enter or import into the App. Family tree data may include information about living relatives, third parties, minors, and deceased persons, including names, photos, dates of birth and death, gender, maiden names, relationships, marriage, divorce, adoption, step relationships, partner relationships, moves, and notes.
When entering, saving, sharing, publishing, or exporting third-party information or photos, users should obtain consent where appropriate and consider applicable laws, social norms, and family circumstances. We do not normally review user-entered family information and are not responsible for its accuracy, legality, or appropriateness for sharing.
5. Import, Export, and Sharing
The App may support importing or exporting family tree data in formats such as JSON, GEDCOM, PDF, and PNG. Exported files may contain personal information, photos, family relationships, events, and notes.
Users are responsible for storing, sending, sharing, publishing, deleting, and otherwise managing exported files. Users are also responsible for checking the source, rights, contents, accuracy, and third-party information contained in imported files.
6. iCloud Save and Restore
The App may let users manually save data to iCloud and restore data from iCloud for use across devices signed in with the same Apple ID. iCloud availability, sync, retention, deletion, restoration, and outages are governed by Apple’s specifications, settings, terms, and privacy policy.
Users should keep separate backups of important data where needed. To the extent permitted by law, we are not responsible for data loss or changes caused by device failure, app deletion, iCloud state, user error, import, or restore operations.
7. Premium and Billing
Purchases and payments are processed through the Apple App Store. Payment terms, billing, receipts, cancellation, and refunds follow Apple’s terms and policies, including the Apple Media Services Terms.
Subscriptions may auto-renew unless canceled before the end of the period. Manage renewals, cancellations, and free trials, if offered, under Settings → Apple ID → Subscriptions or other App Store guidance. Prices, periods, and features follow the App and App Store display and may change. We may use RevenueCat or similar services for entitlement checks. Refunds follow Apple’s policy, including Report a Problem.
8. Ads and Rewards
The App may allow users to unlock some free limits by watching rewarded ads. Ad availability, ad type, reward grant, reward amount, and eligible regions may vary depending on ad inventory, network conditions, consent status, OS/device environment, and Google or other third-party service specifications.
We do not guarantee that ads will always be available or that a reward will always be granted after viewing an ad.
9. Prohibited Conduct
You must not violate laws or public order; infringe our, other users’, relatives’, or third parties’ rights, privacy, reputation, or credit; publish or share third-party personal information, photos, family relationships, or sensitive information inappropriately without consent where needed; interfere with the App; attempt unauthorized access; reverse engineer the App; abuse billing or ad rewards; or commercially resell App features or information without consent.
We may restrict or suspend use for violations.
10. Intellectual Property
The App and related documents, designs, and programs belong to us or the relevant right holders. Users or relevant right holders retain rights to data entered by users. Users grant us a non-exclusive right to use entered data only as necessary to provide, save, display, back up, export, improve, and legally operate the App.
11. Disclaimer
The App is provided “as is.” To the extent permitted by law, we do not warrant fitness for a particular purpose, accuracy of display, aggregation, or export content, data preservation or restoration, or uninterrupted or error-free operation.
We are not liable for damages except in cases of willful misconduct or gross negligence, and any liability is limited to a reasonable extent, subject to mandatory consumer protection laws.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Disputes arising from these Terms will be subject to the Yokohama District Court, Hiratsuka Branch as the exclusive court of first instance, except where mandatory laws allow consumers to choose another competent court.
13. Changes
We may change these Terms. Changes take effect when posted on this page on kitokito.app or otherwise notified. For material changes, we will try to notify users in the App or App Store release notes. Continued use of the App after changes means acceptance of the updated Terms.
